ABPI Code

ABPI Code Compliance for Pharmaceutical Marketing

A practical guide to ABPI Code obligations for pharmaceutical companies promoting prescription medicines to UK healthcare professionals — including fair balance, certification, and PMCPA enforcement.

The ABPI Code and Pharmaceutical Promotion

The ABPI Code of Practice for the Pharmaceutical Industry governs how member companies promote prescription medicines to healthcare professionals and appropriate administrative staff in the United Kingdom. It is administered by the Prescription Medicines Code of Practice Authority (PMCPA), an independent body that operates separately from the ABPI itself.

The ABPI Code reflects and supplements the legal requirements of the Human Medicines Regulations 2012. In practice, it imposes more detailed and demanding standards than the legal minimum, covering not only the content of promotional materials but also the conduct of medical sales representatives, the provision of hospitality and transfers of value, and the relationship between pharmaceutical companies and patient organisations.

PMCPA enforcement is active and visible. Case reports are published quarterly and are freely accessible, making compliance failures public knowledge within the healthcare community. A single upheld complaint can result in a requirement to issue a corrective statement to all HCPs previously reached by the non-compliant material — a significant operational and reputational burden.

Key ABPI Code Clauses for Marketing Teams

    Clause 7

    Accuracy and Substantiation

All promotional information must be accurate, balanced, and fair. It must not mislead by omission, by emphasis, or by inappropriate comparisons. Clinical data must be presented accurately and must include statistically non-significant data where relevant to the overall picture.

    Clause 8

    Prescribing Information

Promotional materials must include full prescribing information (FPI) or an abbreviated version with a clear route to the SmPC. Digital materials must provide a clear, prominent link to the prescribing information. The requirement for prescribing information applies to leavepieces, detail aids, digital presentations, and websites.

    Clause 11

    Comparative Advertising

Comparisons with competing medicines are permitted but must be factual, fair, and capable of substantiation. Head-to-head comparisons must be based on comparable studies and must not exaggerate differences in effect size. Comparisons must not denigrate competitors.

    Clause 14

    Reprints and Digital Content

Reprints of published studies used as promotional material must comply with ABPI Code standards. Digital platforms hosting HCP-directed content must meet the same standards as print materials. Access controls may be required to ensure HCP-only content does not reach consumers.

    Clause 23

    Hospitality and Events

Hospitality at industry events must be secondary to the educational purpose of the event, reasonable, and consistent with HCP professional obligations. Standalone hospitality not linked to a legitimate professional purpose is prohibited. All transfers of value must be disclosed.

    Clause 27

    Certification

All promotional materials must be certified by a medical or scientific signatory (and in some cases also a legal or regulatory signatory) before use. Certification records must be retained for five years. The certifying signatories take personal responsibility for ABPI Code compliance of the certified materials.

Supporting ABPI Code Compliance with LearnedCare Sentinel

LearnedCare Sentinel includes ABPI Code scanning within its pharmaceutical compliance framework. When content is submitted with pharmaceutical context settings, the platform evaluates the material against ABPI Code requirements — checking claim accuracy and substantiation, identifying missing prescribing information references, flagging fair balance concerns, and identifying comparative claims that require additional evidence.

The platform's structured review workflow mirrors the ABPI Code's certification requirements, providing a documented record of who reviewed the material, when, and against which criteria. The audit trail supports the retention requirements of Clause 27 and provides a defensible record in the event of a PMCPA complaint.

For organisations with international operations, the platform provides scanning against UK-specific frameworks with clear delineation from EU or global codes. UK compliance must be managed independently post-Brexit, and the platform reflects current UK-specific ABPI Code and MHRA requirements rather than EU comparators.
